"Fix" one failing test and improve their "infrastructure" #70

Has two commits, first one fixes #69 , the other one bundled to make our lives easier.

I will release if merged, so we get it "cleaner"

well, it is just -deprecated and just a test fix. So if no objections, I will merge it tomorrow on my way to Canada ;)

I agree. No point in changing behavior in deprecated.
