Comments marked as spam still affect the status of the case (especially false Dead comments) #42

Some people have written back in the comments that they are okay, yet trolls 
have added false Dead comments which seem to be taking precedence, either 
because they are "dead" or because they are most recent.

If this is still reproducible, sounds like a relatively serious bug to fix.
