in menu.lua background is defined twice #39

Lines 57 and 60 of menu.lua contain the same information. I tried commenting line 57 out and the menu still works so I am assuming this can be removed.

If it worked fine without it, (and yes, it was duplicate code), then feel free to close the issue and remove the code. I'll close it, as I removed the commented out line in my last commit and sync.
