Spanish Courts data

Dear all,

I am using jurism and writing a comparative doctoral thesis involving several jurisdictions, amongst others Spanish law (in particular company and civil law).

Is there any court data available for Spanish courts?

Unfortunately I am no programmor, but if someone would be willing to assume this tecnical part of the project, I could contribute with the information of the Spanish court circuits and court names.

Dear Florian,

Here is a document with samples of our jurisdiction files. Even if it looks too daunting to prepare a document in this format, if you read the description and take a look at the sample, which show the structure that we need (in whatever form it is delivered). The key point is that we need to set codes for the geographical scope of each jurisdictional subunit, and indicate which courts exist in that particular subunit. With this structure, we can identify the parent jurisdiction of each court (where its appellate court resides.

I will use my best efforts in order to create a court file for Spain at short or mid-term.

I wish you a happy new year and hope 2020 commenced well for you!

As agreed at the end of 2019, I hereby submit you the draft court data for Spain together with the following explanations:

• In the jurisdiction object, I did no add entries for the respective Supreme Courts (Spanish Supreme Court, Central Commercial Register, Directorate General for Registers and Notaries), as these exist only once for the whole Spanish State. In case it is necessary to make entries also in the jurisdiction object, please add them manually. All of these Supreme Courts are defined in the courts object (I marked them yellow in order to enable you to localise them).
• On the one hand, I have limited the jurisdiction entries to the Civil Courts. On the other hand however, I included all Courts (even first instance courts), because it is not possible to classify them in important respectively insignificant courts – in my scientific works and articles, I sometimes have to cite first instance judgements that have become final and binding and have established new legal doctrine. Although it caused me some additional work now, I prefer to have it done once forever instead of being prevented from the publication of a future article if a courts I have to cite is missing and we have to patch if afterwards. Consequently, I would be very grateful if you could implement all data provided by me into IurisM.
• With regard to the local citation rules in Spanish bibliography, it is worth mentioning that abbreviated citations for judgements use the prefix “S”, whereas citations for resolutions use the prefix “A”. Consequently, judgements of the Supreme Court (whose abbreviation is “TS”) are cited as “STS, and resolutions of the same Court as “ATS”, and so on for each court. In my draft, I have not yet added these abbreviations (“S” or “A”), because it is not possible to determine that all products of a certain Court will be exclusively judgements or resolutions.

Nevertheless, it is very important that for each concrete citation, that the type of the document is well defined and appears in the citation (for example in the case of the Supreme Court (“TS”) as “STS” or “ATS”. If you want me to add these prefixes to the abbreviations list in the courts object in my draft, please let me know. If you have a better solution, which ensures flexibility of the citations pursuant to the type of the document in the concrete citation, it would be preferable.
