Application licensing issues and contribution guideline violation #192

While writing https://github.com/flipperdevices/flipper-application-catalog/issues/191 I noticed that a number of applications sourced from: https://github.com/xMasterX/all-the-plugins.git have no license, which is both a violation of your contribution guidelines and of the license (per: https://docs.github.com/en/repositories/managing-your-repositorys-settings-and-features/customizing-your-repository/licensing-a-repository#choosing-the-right-license, no license is to be treated as "all rights reserved" and cannot be reproduced, distributed or have derivative works created from)

a list of application from that repo that have been added to the official catalog by xMasterX that have no license:

after some thought I am noting that because the code is not Reproduced here I will also open an issue on that parent repo wrt the licensing https://github.com/xMasterX/all-the-plugins/issues/29, but the flipper lab distributing them still would be covered by "no one may reproduce, distribute, or create derivative works from"

Hi, sorry, can you explain why this clear violation of the contribution guidelines was closed as "not planned". The inclusion of these apps is not just a violation of your contribution guidelines but also opens the flipper app store to DMCA/other copyright claim for distributing software they are not licensed to distribute?

We accept DMCA and copyright claims only from the owners.

I literally know people from that list and they don't mind those apps being used by anyone who want to support and maintain them.

A lot of software for the flipper was written as a PoC and authors didn't bother with paperwork.

and on the side of being a clear violation of your guidelines?

additionally none of these were added to the repo by their authors, they had no control over this, whether they "mind" or not.

q3w3e3 commented 11 months ago

to be clear, this is... Obviously... NOT a copyright claim, its an issue being opened about the acceptance of PRs that are in violation of the contribution guidelines AND an attempt to open discussion about the CLEARLY lacking review process, as it missed that these PRs were in violation of the guidelines.

There is no violation of our guidelines.

This topic was discussed with new maintainer and some apps authors, from all parties we received consent in one form or another.

Authors can come to catalog repository and open issue if they want control back.

There is no violation of our guidelines.

the Contribution Guidelines Clearly state in their first line "Applications submitted to this repository must be licensed under an Open Source License of your choice" (emphasis mine)

all parties we received consent in one form or another

this is False, for example, I know for a fact that @Nitepone received no communication from @xMasterX before their app was included in @xMasterX's repo NORE when @xMasterX opened https://github.com/flipperdevices/flipper-application-catalog/pull/30

Authors can come to catalog repository and open issue if they want control back.

opinion, but, it feels like this is a project that should encourage individuals to build applications for it, not one where an environment is fostered where its okay to effectively steal other peoples work and that will stand until the author complains. That is not a healthy community.

And now you are cherry picking my words and thats where we end discussion.
