two issues: Xee3 is not open but upon trying to open it, error 600 reports Xee3 is open (and can't be opened)

First of all, if you have any Haxies, InputManagers, SIMBL plugins or
similar operating system hacks installed, please remove them first, restart
the program, and make sure the bug is reproducible without them.

This seems to be an OS X bug. It happens before Xee3 can do anything at all. 
Try reporting it to Apple.
