Select always uses defaultLayer

Even though I choose Select -> Railroads, I get Parcel results. I expect Railroad results only.

To reproduce using the online Full Demo:

turn off County Layers -> Parcels
turn on County Layers -> AGS Dakota County Rail
Select Features -> Draw Box, draw a box in the area containing Rail (and Parcels even tho they are off)
click Go
observe Parcel results are shown.
