update text on terms page #502

Is your feature request related to a problem? Please describe. While doing stuff for The Core Trust Seal application I found some additional bits that would be good to add to our terms and conditions text to help clarify certain points.

Describe the solution you'd like I would like to add two paragraphs our Terms pages on the website http://gigadb.org/site/term

1 -Add the following paragraph to the end of the "GigaDB Services" section.

GigaDB facilitates data sharing and its staff are available to assist users with finding, accessing, and downloading the data. However, for issues regarding; using, analyzing, or understanding the data, requests of this nature should be directed to the author(s) of the data, not to GigaDB staff.

2 - Add the following paragraph to the end of the "Depositor agreement" section.

As an author, when you submit data to GigaDB, you agree to the following:

By depositing these data, software, and/or files (“Content”) in GigaDB I agree that I am solely responsible for any consequences of uploading this Content to GigaDB and making it publicly available, and I represent and warrant that I am either the sole creator and the owner of the copyrights and all other rights in the Content; or, without obtaining another’s permission, I have the right to deposit the Content in an archive such as GigaDB. To the extent that any portions of the Content are not my own creation, they are used with the copyright holder’s express permission or as permitted by law. Additionally, the Content does not infringe the copyrights or other intellectual property rights of another, nor does the Content violate any laws or another’s rights of privacy or publicity.

I confirm that the Content contains no restrictions, private, confidential, or otherwise protected data or information that should not be publicly shared. Specifically, I declare that these data are either;

I understand that GigaDB will do its best to provide perpetual access to my Content. In order to support these efforts, I grant them the following non-exclusive, perpetual, royalty-free, worldwide rights and licenses:

Email discussion with CNGB compliance officer (Tang Yuchong ) has raised a further requirement of the depositor agreement to explicitly require a statement on sharing of Human Genetic Resources:

  • If the data don’t include Chinese HGR, the submitter need to make such declaration that no Chinese HGR data are published.
  • If the data include Chinese HGR, the submitter need to apply for permission. In the application file, they need to assign a Chinese data platform as data publisher. A backup copy need to be stored within China.

Please find the definitions below:

  • HGR data refer to data/information generated from HGR materials.
  • HGR materials refer to genetic materials such as organs, tissues and cells that contain human genome, genes and other genetic materials. *HGR data include the following data types : (1) clinical data, such as demographic information, general laboratory test information, etc.; (2) imaging data, such as ultrasound, CT, PET-CT, MRI, X-ray, etc.; (3) biomarker data, such as diagnostic biomarkers, surveillance biomarkers, pharmacodynamic/response biomarkers, predictive biomarkers, prognostic biomarkers, safety biomarkers, susceptibility/risk biomarkers; (4) genetic data, such as WGS, exome sequencing, target region sequencing, human mitochondrial sequencing, whole genome methylation sequencing, lnc RNA sequencing, transcriptome sequencing, single cell transcriptome sequencing, small RNA sequencing, etc.; (5) protein data; (6) metabolic data.

I think we might need to split the "Depositor Agreement" out into a separate tab.
