warnning messages when parsing <digitalusControl /> tags

What steps will reproduce the problem?
1. add some <digitalusControl /> in the layout file e.g. for ckeditor or some 
other editor but not a moduleselector
2. add some content with tags at the back end by manually adding html tags in 
the editors 
3.

What is the expected output? What do you see instead?
i don't want to see warning messages ........... 

What version of the product are you using? On what operating system?
-r782 ubuntu10.04

Please provide any additional information below.
the simple_xml_load() function will try to parse the content inserted in the 
editors that will generate some warning this is related to issue 166,  
and 167 i think

sorry this one was not related to 167 rather it's 166
