For open-source solutions like CKAN and DKAN, this is moot, but for proprietary solutions, source code escrow should be required.

This is more of a contractual requirement than a product requirement. Perhaps I can add a section to identify those separately. Thoughts?

It may not be a bad idea to have a separate contractual requirements section.

Beyond source code escrow, other items that may go into this section include:

• explicit language about what's in the Terms of Service for SaaS solutions
• imdecification requirements for open source based solutions
• guidance about SLA levels
• guidance about ability to engage third-party vendors/providers
