Status: Confirmed by ManoM, and filed as a bug.

everything checked initially

Google Earth 4.2.0180.1134 Mac

Steps to Reproduce: 
Create a Document with a listItemType of radioFolder and add some features with 
visibility set to 0. If you load it with a NetworkLink it will show up as a 
list with checkboxes that are all initially checked instead.

Workarounds: 
Open as KML file, not through a NetworkLink. If you have to load through a 
NetworkLink, put everything in a Folder inside the Document (haven't tested 
whether Document can be omitted) to emulate the behavior of previous versions 
of Google Earth.
