tool color change button disapears

What steps will reproduce the problem?
The button is not present in any tool menu (highlight, draw atc). If I tap 
"reorder menu items" it reappears, but disappears again if I reenter the menu.

What version of the product are you using?
2.2.1

On what operating system?
Android 4.0.4

What device are you using?
Xoom (Everest)

 I told them since long time about this issue but they reply me that they can not reproduce this on thier device.

This is what happens when I use the "reorder menu items" trick:

Strange, it looks like item take place but its icon have not shown.
