As the capabilities document is a mono-lingual document, internationalized legend may be placed in different capabilities document for each value of the LANGUAGE parameter. It shall be mapped with the ows:LegendURL element.

No requirement for the existence of the legend for each layer, so nothing to check.

However, in the IR Article 11(1) of the Directive, it's said:

b) view services as a minimum, display, navigate, zoom in/out, pan, or overlay spatial data sets and display legend information and any relevant content of metadata;

So the legend is mentioned in the minimum requirements.
