As it is 'optional', conformance is adequately tested with the current 'OR' statement in the test method.
For scenario 1: Add the appropriate conformance class (ATS-Metadata) as prerequisite in order to establish that MetadataURL points to an INSPIRE compliant ISO metadata document. XPath reference: /xs:complexType/xs:choice/xs:sequence/xs:element[@name="MetadataUrl"]
For scenario 2: Based on table 2 [TG DISC], add tests to determine whether each required metadata element is mapped to the GetCapabilities response. Resolution for scenario 2 depends on issue #37
I believe Scenario 2 would be tested by A.2.5, #38

The test does not take into account that MetadataURL can be present, optionally, also in the long scenario.
