In a recent download there were some puzzling positives for this flag (see below). I checked the 559 lat/lons (all to 9 or 10 decimal places) in QGIS against the full-resolution version of the Global Self-consistent, Hierarchical, High-resolution Geography (GSHHG) coastline shapefile (https://www.ngdc.noaa.gov/mgg/shorelines/gshhs.html). All 559 appear to be shoreline occurrences. With these "depth_exceeds_bath" flags is OBIS saying "We think these are on land, but we're not sure"?
