With this license the publisher has waived all rights to these data ,to the extent possible under law, and has dedicated them to the public domain. Users may copy, modify, distribute and use the work, including for commercial purposes, without restriction.
CC-BY-NC license does not remove NOAA, or the federal government, from liability if someone were to use the data for commercial purposes. Additionally the license puts a burden of enforcing the non-commercial use on the Federal Government, and that's a burden we cannot legally assume. It would be easier for NOAA if this license were not used. At the very least, whatever agreement is in place for accepting data with this license needs to be explicit that NOAA is not liable for any third party use, including if it is used for any commercial purpose. NOAA has no control over how data may be used by third parties.
