permission to use uTorrent WebUI #64

hi guys - just wondering if you sought and received permission to use the
uTorrent webUI code as a starting point for your project? (don't be worried
by my question, I just want to know...)

No, i don't receive any permissions to use it. AFAIK, this is impossible - see
http://forum.utorrent.com/viewtopic.php?id=51271
As result, if somebody from BitTorrent, Inc. (or Directrix as main developer of
uTorrent webUI) will have any claims to me - this project will be immediatelly 
closed.

BTW, last unstable version of uTorrent WebUI (0.362) contain *my* code (speed 
tab) ;)
And i don't give to somebody any permissions to use it ;) 
This is a joke, of course.

Я попытаюсь прояснить ситуацию у directrix (по 
почте). По крайней мере, получить
внятный ответ насчет изменения и 
редистрибуции кода. О результатах отпишусь.

Насколько я понял (см. линк выше) уже 
выясняли. Краткое резюме - нельзя. Хотя
ситуация действительно странная - 
упоминаний о лицензии нигде нет; код 
разрабатывался
directrix-ом (котрый ни разу не сотрудник BitTorrent), 
а сейчас - и вообще не пойми
кем, даже я там поучаствовал; при этом WebUI 
считается собственностью BitTorrent inc.
Хотя с другой стороны, поинтересуйтесь - за 
спрос денег не берут.

i would be very disapointed if the project was shut down...this is by far the 
best
front end for rtorrent and rtorrent is the best client for *nix

I'll get back to you soon when I've done a bit more research - I don't think we 
want
to shut your project down, although the licensing you're using at the moment 
might
need to be amended slightly - you can't just take our code and GPL it (e.g. 
maybe we
need to open-source it first) - more soon

I agree. This happens because googlecode has restrictions for projects on it. 
Any
project on googlecode should satisfy with one of the license from that list -

Apache License 2.0
Artistic License/GPL
Eclipse Public License 1.0
GNU General Public License v2
GNU General Public License v3
GNU Lesser General Public License
MIT License
Mozilla Public License 1.1
New BSD License

As result, i can
1) Specify for my project some another license (from the list above)
2) Move project to another hosting, without such restrictions (but i don't know 
-
what i need to write for it in license section?)
3) Close project
4) Rewrite a part of my project, which use your original code (this is a very 
hard,
but possible, i think)
5) Something else? As you wish, in common.

2shasvirnus - this is a really point 2, i think. Because projects with such 
states
can't be placed on googlecode. AFAIK.

if it DOES come down to it i think unfuddle has no such restriction.  I think 
they
will allow you to host any type of license. I honestly hope you aren't forced to
abandon the project but if you DO have to move I'll help in any way i can.

I did some research on this issue and even I did registered on utorrent forum
(http://forum.utorrent.com; btw, this forum works properly under IE only, I 
don't
know why it might be). The information I've found (
http://forum.utorrent.com/viewtopic.php?pid=427107 ) gives me no results (I've 
got
the things that I've already know). I see, Directrix (webui developer) currently
isn't available through e-mail.

I think it would be right be wait for their official decision (bittorrent and 
co.),
surely if `smorris` is an employee in it.

Hi there. I remember Novik from back when the µTorrent community made a
multi-language version of the webui (
http://forum.utorrent.com/viewtopic.php?id=34079 ) and he indeed was the first 
to
introduce the speed tab :)

Sad to see you left µTorrent and moved on to rTorrent but still all the best. 
But I
do want to provide my view of this issue. Hope it helps.

Simon Morris is a known employee of BitTorrent, Inc. (
http://www.bittorrent.com/company/management ) and since Simon/smorris is using 
a
BitTorrent.com (owned BitTorrent, Inc.) email address you can be fairly certain 
it's
him. You can always mail him to confirm if you think this is an impersonator 
but I
myself find it very unlikely.

I think the questions that have to get answered before you can continue this 
project are:
1) Did you use code written by Directrix (i.e. webui.zip)? 
    No -> Issue resolved.
2) Who has the final say on the rights to that code?
3) Do you have permission to use this code?
4) Does (or will) this permission include restrictions that force you to change 
your
own license scheme?

Notes that might help with the above questions:
* The source files of the webui.zip refer to both BitTorrent, Inc. and Carsten
Niebuhr (Directrix) as copyright holders (
http://trac.utorrent.com/trac/browser/webui/trunk/webui.js ).
* 'All rights reserved' means you are NOT allowed to use the code without 
permission.
* To keep your project under public license they'll probably have to release the
webui.zip code under public license. Luckily the webui.zip is basically 
completely
separate from µTorrent itself so this isn't a far fetched idea and from Simon 
Morris
words above they might actually be prepared to do this.
* You don't have to worry about the mootools framework ( 
http://www.mootools.net/ )
because they use the MIT OSI License (
http://www.opensource.org/licenses/mit-license.php ) which allows you to use 
it's
code under virtually any other license, even proprietary.

I just hope they don't try to shut this project down.  rtorrent is the way to 
go when
it comes to torrenting with *nix.  And this front end is wonderful.  Does 
anyone know
how to get in touch with Directrix?

As previously mentioned we have no interest in shutting down your project. We 
are
working on releasing a version of the WebUI code under an open source license - 
we're
going to take a few days to make sure we do it right. One thing we will ask in 
return
is that you use a different logo for your project - will you guys be ok doing 
that?
(the reason for this is we have hardware vendors who pay us for the rights to 
put our
logos on their devices - if we allow people to use the logo (or one obviously 
closely
styled around it) freely, then it makes it easy for them to say "no" - which
undermines one of the few ways we have to make money. I hope you understand 
this.
More soon on an open source webUI. Feel free to post here or else email me
(simon@bittorrent.com) to suggest an exact version to open source (I'm inclined 
to
start with the version distributed currently with uTorrent).

I don't think that is a problem in any kind; we will change the logo asap (when
changing license routines will be done).

ruTorrent use the previos version of webui (0.310) as a starting point. This 
version
1) doesn't use mootools.
2) In it's source files i can't find lines like 'All rights reserved' or any 
refer to
BitTorrent, Inc. (refer to Directrix is present in the interface window, in 
ruTorrent
it is present too).
3) Of course, this doesn't allow to me any permission to use this code.

I think, this is a joke ;) But you can try, of course. We need 2 logos with
dimensions - 153x55 (or lesser) for google and 16x16 for favicon.

вариант. Единственное условие - 
бело-зеленая гамма не подходит - чтобы не 
напоминало
лог uTorrent.
