sometimes does not work

What steps will reproduce the problem?
1. reboot 
2. forget to run ME (even though I have fake on boot)
3. will be asked for Market Terms and Conditions and be in the wrong market

What is the expected output? What do you see instead?

What version of the product are you using? On what ROM?
Can't tell (no about page) but latest from Market.  I am on GSM Evo 3d Rogers, 
rooted and running Virtuous 1.02

Please provide any additional information below.
Seems random, and a pain to fix.  Have to uninstall the new Market (phone 
shipped with the old green market) and reboot, install new market, reboot, use 
ME, reboot, use ME, and then hope it stuck!!!  Fastboot on or off doesn't help. 
 Sometimes works fine on a reboot but if I forget to check ME has run already 
its crazy hard to get working again...

Attach a logcat output if possible.

Tried clearing cache as for the HTC Hero thread, but this doesn't fix the 
problem.

Doesn't work on old Market either.  Busybox is installed.  Clearing cache in 
'applications' does clear the directories mentioned (can navigate to 
data\data\com.android.vending\ and see that its empty) but just not working any 
more.  Used to work!  Frustrating no end!
