Perhaps a simpler solution is to add a "by clicking this button you are agreeing to ..." on the upload button.

That makes sense. Jeremy mentioned that he'd be in touch with someone about the specific wording of those disclaimers, as what I've added as a placeholder probably doesn't suffice legally.
