Oh if that is the case then the Touch Pro simply doesn't the geo api of gears I
assume. Is there a different API you can use for the mobile internet explorer?

On the HTC Touch Pro - this demo DOES work:

The location is wrong, but it at least gets a reading.
The Palm Treo Pro doesn't work, so I think you're right - it doesn't geo the
API of
gears.

this is interesting. it seems that google gears returns
p.latitude
p.longitude
but also
p.coords.latitude
p.coords.longitude
i made a test and uploaded it to:
http://www.merkwelt.com/people/stan/geo_js/sample.html
could you please verify that this works?

Retried: "Functionality Not Available" on HTC Touch Pro 2 - Windows Mobile 6.5.
Same result on Palm Treo Pro.
The Google Gears GeoLocation Demo doesn't even work, so I think Gears API just
doesn't work with these devices.

yes, google gears might be available, but not the geo location component of the
framework.
