vara modem start, returns failed (using bap-beta-3.3.0)

on the latest dev branch (and beta) clicking start on the VARA modem will start the modem and return a fail code in the patmenu

suggested fix https://github.com/km4ack/patmenu2/pull/67 the issue is a legacy way to look for the running process which hangs up the script
