I have searched a lot over this and there seems to be some thought as to a problem with ZFS file system and something to do with the way lsblk has changed something in the headers? I found a post saying about rebuilding it with a change but that is outside my area of confidence. It was also posted some 3 or so years ago and I don't want to tinker with advice that may not apply to the latest version.

All I want to do is upgrade to the latest Mint but I can't do a backup as recommended in the upgrade guide using Timeshift

Hello, ZFS is not supported by Timeshift, you can take a look at this issue which is related to your question : https://github.com/linuxmint/timeshift/issues/56
