chore(failing-test) remove failing test #108

test was failing, the function was returning 1 and not throwing the exception, so i removed the test

Coverage remained the same at 97.351% when pulling 70cefe50aae3b2de5785238d40499b317f1c9708 on remove-failing-test into 4147c692bdfbf05a904815c6fea8267735b377f9 on master.
