Less than or equal to 40% is equivalent mathematically and computationally to less than 41%. This is an attempt to standardize the nomenclature of the CCWPs as much as possible.

Less than or equal to 40% is NOT equivalent mathematically and computationally to less than 41%. 40.5% would be included in your choice of words, and not in ours. These words had a great deal of review in the white papers, and are likely to be correct. We need to get to this level of granularity so programmers can code accordingly.
@kthlnkeating this appears to be a clear mechanical error vs. the CCWP. Please fix.
See comment 98-99-159. White paper chapter 2, section 2 says <40%. XML and TSR both say <41%.
