removing outer markup causes error if summaries exist #146

What steps will reproduce the problem?
1.markup several paras and enter a summary
2.markup a subset of the paras in step 1 and enter a summary
3.remove the outer markup
4.view the session xml and observe that there are some orphan summary elements

What is the expected output? What do you see instead?

What version of the product are you using? On what operating system?
0.9.7b3 - linux
