(The Can Lady Recycling Property) ~ Health and Hospital has TRA19-06613 due in Environmental Court on Oct. 29 - Final Hearing. We (BNS) have an open Vehicle Case in legal (VEH19-000613) for an inoperable vehicle on her property. She also has an active Zoning case (VIO19-001526) in legal for the following;

Chelsea and I visited the Can Lady yesterday and she plans to complete cleaning up the outdoor area around her home by Monday, Oct. 14. Her attorney, Mark Sniderman (317-698-9397, Msniderman@findlingpark.com) was present at our meeting and is aware of the plan. Supposedly, Mary is in compliance with the State, but not the City. She would like to continue parking her 2 recycling vehicles on the street in front of her property along with a couple of collection bins for drop-offs, but this displeases a couple of the neighbors. I will meet with the most vocal neighbor across the street, Kim and Doug Morris, and determine if they can live with this arrangement after I check with the City to determine what is permissible. Will update on Monday to report on whether all recycling materials have been removed from the property. Mary would like to continue with her recycling activities but is growing weary of neighborhood complaints. MKNA will work toward a peaceful resolution!

As you may know the magistrate ruled in MCPHDs favor for 5310 Central’s case. The property has been cleaned by the owner and a permanent injunction (PI) was granted. A PI allows us to file the case for court immediately should the property become in violation again.

Mary Stumpp received notice of a zoning violation (Complaint for Permanent Injunction and Fine) on November 8 (filed on Oct. 28) for operating an illegal home occupation. Hearing Date not yet set.
