We currently record by default anybody attached as Listener to the orb (their character and its movement). The audio track comes from a recording that captures all speakers within some distance of the Orb (and I think we can reasonably approximate that by people Attached as Listener). We should be showing a "Recording started" (if you're attached when the replay recording beings) or "Recording in Progress" notification to anyone Attached as Listener.
This is tricky in a few ways.
Firstly, it is not practical from an audio processing point of view to filter the audio only for people who have agreed to be recorded. So the warning basically has to say "if you're here your audio will be recorded and shared, in both YouTube and in Replays" and if you don't want that, you just choose to not speak. I think this is fine.
On the other hand, we could meaningfully offer an option to include your character model in the replay or not (currently defaults to being included). I think it's great to see the audience in the replays, but obviously we should be offering the opportunity to opt-out as well. This has a difference semantics than opting out of being voice recorded, because if you don't want that you simply don't ask a question (and most people don't anyway). However, if we automatically record the character of anyone Attached as Listener, then the only way to opt-out of that is to Detach, meaning you can't participate properly by e.g. using Orbcam.
So what that suggests is: the notification says something like:
This event is being recorded and may be shared publicly on YouTube, in metauni Replays and elsewhere. Transcripts may be made publicly available and processed by AIs. By participating you agree to including your voice in these recordings and transcripts. You may opt-out of having your character included in the Replay.
[ tick ] Agree to having character included in replay
[ ] Do not show this notification in future
OK
I can't think of a meaningful other button, if you don't want to have your voice or character recorded but want to continue attending, just untick that box and click "OK". Once you do so, a topbar item is added that says "Recording" and clicking it brings up the same notification with the same options. If you detach it goes away, and obviously it goes away if the Replay stops recording.
