uploading the same file 2 times dont warn the user of duplicate name

What steps will reproduce the problem?
1. gcp /home/matteo/foo.txt <em@il>:/<any_label_or_root>

What is the expected output? What do you see instead?
The second upload expected output should be:
0 successful, 0 not allowed, 0 failed, 0 updated, 1 duplicate names

but we have:
1 successful, 0 not allowed, 0 failed, 0 updated, 0 duplicate names

Please use labels and text to provide additional information.
