I would certainly agree. Let's just make that a task.

• If selecting two tied notes and adding an interval to them, the interval should also be tied.
• If selecting two chords, which contains a mixture of tied and untied notes, and then adding an interval, only pay attention to what the top two notes of each chord are doing.

So: in this case, since the top two notes aren't tied, don't tie any newly added intervals:

Closing since this seems to have been addressed some time ago (in 4.1), though at this point I can't recall exactly where.
