Review content of the entire L08 collection and decide on possible extension request (BODCNVS-2275) #1

A review of L08 is being proposed following a request we received from outside of SeaDataNet to extend L08: SeaDataNet Data Access Restriction Policies with the additional policies listed below. This ticket aims to gather the requirements for L08 and whether or not it could be extended to serve another related-community needs (Ocean Best Practice System).

 

Public Domain Works that are not protected by copyright and are free for use by anyone for any purpose.
CC0 1.0 Universal A public domain dedication where creators have waived all their copyright and related rights, effectively placing their works in the public domain.
CC BY-SA (Attribution-ShareAlike) Allows others to remix, adapt, and build upon the work even for commercial purposes, as long as they credit the creator and license their new creations under the identical terms.
CC BY-ND (Attribution-NoDerivs) Allows for redistribution, commercial and non-commercial, as long as the work is passed along unchanged and in whole, with credit to the creator.
CC BY-NC (Attribution-NonCommercial) Allows others to remix, adapt, and build upon the work non-commercially, and although their new works must also acknowledge the creator and be non-commercial, they don’t have to license their derivative works on the same terms.
CC BY-NC-SA (Attribution-NonCommercial-ShareAlike) Allows others to remix, adapt, and build upon the work non-commercially, as long as they credit the creator and license their new creations under the identical terms.
CC BY-NC-ND (Attribution-NonCommercial-NoDerivs) Allows others to download the works and share them with others as long as they credit the creator, but they can’t change them in any way or use them commercially.
No Creative Commons Refers to works that are not licensed under any Creative Commons license, meaning they may be under traditional copyright restrictions.
All rights reserved Indicates that the creator retains all the rights provided by copyright law, including reproduction, distribution, and adaptation rights, and the public cannot use the work without explicit permission.

First concern raised was about the impact n MIKADO: Are we sure that this longer L08 list will NOT appear in MIKADO, as that would create a major problem when SeaDataNet data providers then could (and would) choose other than those agreed for SeaDataNet.

Answer: MIKADO uses the L08 list, which currently contains 14 values, but among these 14 values a filter is proposed with only two values: RS and CB. The CB value corresponds to the CC-BY 4.0 (international) licence, while the RS value corresponds to "by negotiation" data. It means that the proposed terms could be added to the L08 list without any impact on Mikado.

However, this raises a more general question about the L08 list. If it is supposed to describe the terms used to represent and classify data access policies in operation in the SeaDataNet then it is not up-to-date. 12 values are no longer used. Should they be deprecated? or should the scope of the collection be changed?

For example in this list, we find the CC-BY 4.0 and the SDN license, however the SeaDataNet data policy https://www.seadatanet.org/Data-Access/Data-policy) indicates that the SDN license has been replaced by CC-BY 4.0. Should the SDN entry be deprecated and should it point to the CC-BY 4.0?

Other comments also asked for caution in extending L08 and changing its purpose effectively, pointing to the fact that the proposed new entries replicated existing entries and, in any case, are no longer acceptable in SeaDataNet.

Other question: do we need a separate collection that lists all possible licenses? or just the Creative Commons ones? Are there not already lists of these maintained somewhere else? One such list can be seen here: https://choosealicense.com/appendix/

Another reaction to the proposal: I also believe that the extension of L08 will create unnecessary confusion for several reasons. An important one is that choosing the appropriate CC license can be quite complex, particularly for scientists and often their choice is not correct. For example, some scientists who submit data to SeaDataNet consider that the CC BY-NC is preferable than the CC-BY license since SeaDataNet is a research data infrastructure and not a commercial one. Also, the ND option (NoDerivs) is not in line with SeaDataNet scope as its data are used for derived products. As already mentioned, SeaDataNet "unrestricted" license already covers the CC0 and Public Domain, and already includes the CC-BY.
