Potential EULA violation #1

Dear osp,

It has come to our attention through FontFinder that your hosting of nimbus-diagonal.otf in this public repository could be a potential violation of the End User License Agreement (EULA) between yourself and the respective foundry.

We recommend that you remove the files to avoid further action.

Sincerely, The Font Police

Dear Font Police,

Since you say you are the police, I would like to see your badge! Who are you? Your website has no identifying information.

I don’t think you’re the police. People dress up like the police to steal from old people. Bad first impression!

Second bad impression, you didn’t actually look in our repository. I guess you are a bot!

Nimbus Diagonal was a font created by us from Nimbus Sans, a font available under GNU General Public License version 2.0. This license allows creating derivatives and redistributing them, provided that they are licensed under the same license.

Why are you operating under the impression that an OTF file in a public repository violates someone’s EULA?

What is your aim with your message?

You do understand, I hope, that your message in no way contributes to a larger understanding of font licensing, and only helps to spread Fear, Doubt, and Uncertainty amongs fonts users. Or that might be your aim.

I see you’ve been opening pull requests like this all over Github, often on repositories that include Open Source font binaries like Source Sans or Nimbus.

I feel tempted to report you to Github as spam, but maybe you can first answer my questions.

All the love!

Eric (OSP)

Dear Font Police,

My colleague helped me figure out what’s happening, your website has a function to report fonts:

screen shot 2015-09-09 at 22 24 32

I imagine you are doing some kind of advocacy thing by showing how easy it is to find fonts on Github that don’t respect the licence, or whatever, but can you please turn off this reporting function?

If you want to instruct rights holders on how to deal with infringement you can provide some example copy and explain them how to file an issue. But don’t go anonymous robo style—it makes for errors and confusion. You’ve already filed issues with 5 repos that bundle Open Sans, whereas it is perfectly fine to redistribute Open Sans!

Dear osp,

As requested, here is my badge: ff-police-badge

I am unable to comment on both my intentions, and issues not relating to this one in particular.

In regards to nimbus-diagonal.otf, your testimony will be considered as evidence—however the outcome is still pending.

Sincerely, The Font Police
