11 years ago I'm seeing it in the HTML5 Character Entity Reference Chart from the W3C. So, it may have been invalid at one point for HTML, but now it is no problem.

W3Schools claims that ' is a valid HTML entity. Visit their own page in IE8 to see that it's not - it's only valid in XML.
