No, jquery mobile is not required at all.
Specify more details on your issue: version of mobiscroll, op. system and
browser.
It is a known issue that mobiscroll does not work on Windows Phone, Firefox
Mobile, WebOS and on some BlackBerry phones.

I found it was jquery validate, but I don't know how to resolve it. If I load
the script at all, I cannot load the script. I'm just jquerymobile beta rc1,
jquery 1.6.4 and jquery validate. I will have to track it further. Do you
know of any other issues related?

I found that the issue was jquery validate 1.5 doesn't work well with
mobiscroll. It works now. Thanks :) I also added some preventDefault[s] to
prevent the background from touchmove and the non-scrollable areas.

w did you work in windows phone? I could not understand what you did.

Currently it does not work on windows phone < 8 (not tested yet on 8).
IE on windows phone has no touch events and the mousemove events are not fired
at all.
