The only thing that really irks me about the Plone CA is the following:
I hereby represent and warrant that I am the sole copyright holder for the Work and that I have the right and power to enter into this contract. I hereby indemnify and hold harmless the Foundation, its officers, employees, and agents against any and all claims, actions or damages (including reasonable attorney's fees) asserted by or paid to any party on account of a breach or alleged breach of the foregoing warranty.
This means that even if I write and submit code that is completely my own, I am legally and financially on the hook if someone were to claim copyright on my code, and the foundation can basically forward the bill for the copyright infringement on to me.
IMHO the Foundation should help protect members as a collective organisation against such frivolous copyright claims to make sure their members aren't bankrupted due to some troll claiming copyright on the naming of functions (Oracle vs Google...).
Knowing how much lawsuits and how long they take here in the US signing this agreement is tantamount to taking on a huge liability, even if I know the code I wrote is mine.
@bertjwregeer how would you amend that clause, including removal, to your satisfaction? Anything and everything is on the table.
Assuming a CA that assigns copyright to a Foundation is required, then you want a guarantee that the Foundation will protect its property (your contributions), and therefore you against frivolous lawsuits. Is that about right?
The following Pylons Project core contributors will need to download, print, sign, and email to agreements@plone.org the Plone CA in order to participate freely in the Pylons Project Assimilation.
