Should the terms include a ban on publishing performance data?

I say no. Those terms mostly came from an old Oracle license, which in turn may have been a flowdown from some upstream requirement.

The way I've heard it, the clause did come from Oracle, but if it flowed down, it flowed down from Larry. I've read that he also instituted a blanket ban on hiring from the computer science department where DeWitt worked as a professor.
