i was reading https://privacytests.org/ . On there you write that you
tested Brave version 1.38, however upon trying to download that I found
out the version identifier seems incomplete. There are at least 92
minor versions of brave 1.38. Assuming you meant 1.38.0 i checked that
but according to the source code repository no such 1.38.0 version

https://github.com/brave/brave-browser/tree/v1.38.1 does exist though.
Can you please provide the exact version number that you tested and
certified on your site as well as the operating system these tests were
performed on and crpytograpic hashes of the binary if an official
public build was used?
