XML Output Encoding not strictly enforced

What steps will reproduce the problem?
1. Run Gallio/MbUnit v3.0.5.546 over a file with an actual copyright symbol 
embedded in the "Copyright" field of the assembly metadata
2. Gallio XML output is generated with a UTF-8 header, but the "Copyright" 
entry for the assembly metadata is written with a UTF-8 incompatible symbol 
for the copyright character
3. Run Nant xmlpoke task on the Xml output file from Gallio. Task dies on 
the line with the incompatible copyright character

What is the expected output? What do you see instead?

Character set used should match the file header UTF-8 or UTF-16

What version of the product are you using? On what operating system?

MbUnit v3.0.5.546 on Windows Vista x64 Business.

Please ignore and/or delete this request. Further investigation appears to show 
an 
issue with Nant xml transformation and not the source file produced by 
Gallio/MbUnit.
