I don't think it's related to terrain height; has occurred even at same height through intervening terrain.
I think it's been fixed - turns out there was never a LoS check for AI attacks.
It's not fixed - continues to occur.
There's a persistent issue with enemy units that are out of the player's Field of View having a Line of Sight to the player. It might work the other way too, but in any case it seems to be related to how the LoS function handles different elevations.
