Task: Prevent usage of count(NULL) #3

Hi,

there is a warning about usage of count on NULL. I removed that by assigning an empty array just before the if clauses.

Additionally I found some missing refactoring in in usage of $TCA and not $GLOBALS['TCA']

great, thanks a lot for your input and fix suggestion!

I implemented it with own commits slightly different, to keep the history clean and make it one more time compatible for the older branch for TYPO3 7.x-8.x
