net-analyzer/w3af-9999 fail to build "Failed Patch: disable_dependency_check !"

What steps will reproduce the problem?
1. emerge '=net-analyzer/w3af-9999'

What is the expected output? What do you see instead?
Install and working. It crashed during src_prepare.

What version of the product are you using? On what operating system?
Pentoo's layman at revision 5733.

Please provide any additional information below.
A few lines changes and patch is unable to do it's job; I attach the updated 
patch.
