So assuming the logic in https://github.com/triplea-game/triplea/pull/12696/files is how we get here, I think the only way it can happen is if we reach the return at the end of that function and haven't found enough units to assign hits too.
BUT, I think that's supposed to be handled by autoChooseCasualties
logic.
