Opt out sounds fair to me. If the website is publicly accessible, I don't see why it can't be archived. archive.org has been doing that for decades. Services that showcase a website by screenshotting it in different browsers aren't much different. Allowing users to opt out from being archived sounds reasonable.

Maybe you could scan for the LICENSE file if it's included? GitHub provides some information here on License files. I think what you're doing is fine though. If a portfolio site is hosted on GitHub Pages, it's likely open source by default unless they are running a private repository. Even then, you're just showing a small gif of the site. I don't think there's anything wrong with that. If someone dislikes their site showing up on the list, they can opt out or contact you if it bugs them.
