if syncinner is disabled it will give error.

Actually maybe not a bug.

\begin{align}
|
a_{11}& =b_{11}&
a_{12}& =b_{12}\\

then the inner file would have

⟨blank line⟩
a_{11}& ...

The question is why does it not give error when syncinner is enabled.

Maybe the real bug is in rescansync. But this one is a bit difficult to fix...
