Mailing Subscribe Page: missing check if user exists

If I check Check to use the Communications Preferences page instead of the default Mailing Subscribe page. when a user registers to /civicrm/gdpr/comms-prefs/update page, no check is made on the existance of the contact and a new one is always created.
