Importance - Cannot load XHTML if the content has been the character "&"

[GoogleCodeExporter]

i cantnot create object with 
phpQuery::newDocumentFileXHTML($template) or
phpQuery::newDocumentXHTML($template) 
if the content have been the character "&" 

the code:
