After exploring the potential user experience and how this can be technically implemented the conclusion is this should NOT be done now. It could potentially be revisited and later added if it is felt be essential, but after some user research.
In particular, the supporting docs design maximises the content-to-chrome ratio at all screen sizes. A left hand ToC with it's very long item names will significantly reduce this and go against the design. In addition the right hand sidebar would need to be moved or the included external links moved to the main content, reducing readability. Unless level 1 (Objectives) is collapsible ToC items, including the current one, will be pushed below the fold or be scrolled off screen. We also need to consider the impact on RtL or BiDi language translations.
In mitigation for not having a ToC:
Plus the effort required is considerable given technical complexity of integrating a left ToC pane within the current WAI site so that it works well at all screens sizes and with a manual toggle .
Note that the design guide is also included in the W3C technical note Making Content Usable for People with Cognitive and Learning Disabilities. This does provide a left hand Table of Contents as well as a mechanism to hide / show it.
Thus this version could be used if people really do feel a need for the ToC to be visible all the time.
