This is a good question. Have you looked at either the MIT or BSD licenses?
I have looked at MIT, Apache and GPL. Neither of them say anything about protecting brand related files (like images) while keeping others open source. I might be wrong though because I'm not a lawyer.

Don't you have to file for trademark though? I know copyright is automatic.
no idea about a trademark. is that even necessary? i'm thinking it might be overkill for this, but its your call if you want one.

it sounds like service marks covers images and product names will cover the name.

We want the code to be open source, but we should protect the name (idreamoftoast) and the images we create.
