fix new warnings in tests #79

unclear what's going on, needs investigation: Warning (test_var_types.R:29): kronecker variance estimation works 'length(x) = 2 > 1' in coercion to 'logical(1)'

i am not sure what i did to fix this but it no longer gives a warning
