Yes The OpenSource version of the Toolkit is free to use. That has not changed. Only the Plus edition can be bought.

But only for non Comercial I thought. Thats the Text from your Licence in the Repository

3.6.0 and before are MS-PL. 3.7.0, 3.8.0 and 3.8.1 were released with the Xceed License. Then we decided to offer one last version under MS-PL : v3.8.2. Then, starting at v4.0, all the following versions use the Xceed License (for non-commercial use).
So if you want to use an MS-PL version, use the latest one with that license(v3.8.2) and if you want an up to date version, use the v4.0+ versions (under the Xceed license).
We are using the component with the current version of 3.4.0 to support our requirements.
Now, we want to migrate our code to v 3.8.0 (using the code (https://github.com/xceedsoftware/wpftoolkit/archive/refs/tags/3.8.0.zip).
We noticed the license is marked as Microsoft Public License (Ms-PL) as published at https://github.com/xceedsoftware/wpftoolkit/blob/master/license.md
Is it allowed to use version 3.8 with patching our changes for any issues without purchasing the license or use the earlier version of 3.7 (code at https://github.com/xceedsoftware/wpftoolkit/archive/refs/tags/3.7.0.zip)? Like to know whether it invite any legal hassles?
