What determines water elemental crit? Is it currently equipped gear, does it snapshot, or does it not scale with crit?

Testing "Does Ele Scale with Character Crit"

Preparation:

Ensure Advanced Combat Logging is enabled
Remove all gear and equipment from your character.

Test Steps

Run the command "/combatlog"
Summon Water Elemental
Command Water Elemental to attack target dummy
Wait for approx 100 water bolts to cast
Equip gear to reach approx 10% crit
Command Water Elemental to attack target dummy
Wait for approx 100 water bolts to cast
Unsummon Water Elemental
Resummon Water Elemental
Command Water Elemental to attack target dummy
Wait for approx 100 water bolts to cast
Run the command "/combatlog"
Upload log to Warcraftlogs and note date/time + test in log title

Water Elemental does not appear to scale with character hit, crit or haste in PVE content, though haste is currently bugged in the WotLK beta.

No gear

Near SWP BIS gear
